What these terms cover. These are the terms and conditions on which we supply products to you, whether these are goods, services or digital content. These terms and conditions create a contract between you and Chadi Limited (or Chadi – Feel Good Luxury).

Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms (or require any changes), please contact us to discuss further at: info@chadiluxuruy.com.

www.chadiluxury.com is a site operated by CHADI LIMITED (Chadi – Feel Good Luxury) (”We”). We are registered in Hong Kong under company number 70352295 and have our registered office at Unit B, 14 Headland Road, Repulse Bay, Hong Kong. Our main trading address is the same as our registered office.

We are a global e-commerce platform dedicated to pre-owned luxury goods, vintage goods or rare goods.

We are regulated by Hong Kong laws.

We are a limited company.

How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.

”Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

By using our site, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms, you must not use our site.

We recommend that you print a copy of these terms for future reference.

How we will accept your order. Our acceptance of your order will take place when you receive notification by email upon your order, at which point a contract will come into existence between you and us.

If we cannot accept your order. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because a credit reference we have obtained for you does not meet our minimum requirements, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

Your order number. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

Assessment, Authentication and Swiss Certification. From luxury watches and jewelry, handbags, small leather goods to high-end clothing, shoes and accessories, each luxury item is inspected, authenticated and certified by our team led by Swiss experts. We provide our Swiss expertise to not only certify the quality and authenticity of each product but also to assess the fairest prices for all our clients, whether they buy or sell.

Professional display. In order to present items in the best light for future acquirers, our studio takes professional photos and handles their publication and product details on the website. On some selected items, lifestyle images are available; however note that only the selected item is comprised in the price offer.

Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colors accurately, we cannot guarantee that a device’s display of the colors accurately reflects the color of the products. Your product may vary slightly from those images. Although we have made every effort to be as accurate as possible, because our products are pre-owned, the descriptions, conditions, dimensions and measurements are for informational purposes only.

Pre-owned products. Luxury goods range from designers’ handbags, small leather goods, clothing, shoes and accessories to exclusive high-end jewelry and watches for both women and men.

Product type of each item: the pre-owned luxury goods we present are either(1) pre-owned new, (2) pre-owned, (3) rare or (4) vintage:

  1. Pre-owned new: an item that is categorized as pre-owned new means that it has belonged to someone but has never been used. Pre-owned new items are in perfect condition and original tags are still attached.
  2. Pre-owned: an item that is categorized as pre-owned means that it has belonged to someone and that it has been used. Pre-owned items are either in excellent, very good or good condition.
  3. Rare: an item that is categorized as rare means that it is a luxury product that it difficult to find either in off-line or on-line stores. Rare items are either in perfect, excellent, very good or good condition.
  4. Vintage: an item that is categorized as vintage means that it is a luxury product that has been released before 2000. Note that production years of vintage items are based on our best estimates. Vintage items are either in perfect, excellent, very good or good condition.

Condition criteria of each item: the pre-owned luxury goods we present are either in (1) perfect, (2) excellent,(3) very good or (4) good condition:

  1. Perfect condition: an item in perfect condition can only be in the pre-owned new product category as it is pristine. The item has never been used, is in its original condition and original tags are still attached.
  2. Excellent condition: an item in excellent condition is either pristine but the original tags are removed or has been used once or twice. The item may have light scuffs and light wear and tear marks that are hardly noticeable.
  3. Very good condition: an item in very good condition has been used a few times. The item may have few scuffs and wear and tear marks.
  4. Good condition: an item in good condition shows noticeable scuffs and wear and tear marks. This condition criteria is the minimum requested condition to accept your consigned item(s).

Product packaging may vary. The packaging of the product may vary from one order to another.

Brand requirements. We reserve the right to accept or refuse any item from any brand on a case-by-case basis.

If there is a problem with the product. If you have any questions or complaints about the product, please contact us. You can write to us by email at: info@chadiluxury.com or by mail at: Unit B, 14 Headland Road, Repulse Bay, Hong Kong.

Delivery costs. The costs of delivery will be as displayed to you on our website. Please see below ‘Shipping costs’ for more information.

Shipping costs:

For Buyers. For buyers based in Hong Kong & Switzerland, shipping costs are waived. Chadi – Feel Good Luxury’s secured contractor will ship your ordered item(s) for free at your doorstep. For international buyers (all countries except Hong Kong & Switzerland), shipping costs amount to 40 USD. Our secured contractor for international buyers is FedEx.

For Sellers or Consignors. For sellers or consignor, shipping costs and shipping set ups are at the seller/consignor’s own charge and responsibility. We recommend to use FedEx as they are top professionals and will do their utmost best to make sure your package(s) reach(es) our offices.

When we will provide the products you have ordered. We ship globally. Our secured contractor will deliver your order to your doorstep within 1-6 days (depending on the destination). During the order process we will let you know when we will provide the products to you. Once you have confirmed your purchase, you will receive a first email confirming your order and you will receive a second email during the following days with a tracking order and an estimated delivery date. The mentioned time frames for each order do not include potential customs clearance processes.

When you ask us to source an item for you. We will spare no efforts in trying to source the product you wish for but we cannot guarantee that we will find it. Finding your wished item will depend on whether or not our clients, brands or suppliers have it in stock. If we do find the product you wish for, our commission will depend on the said product. The more expensive, the less commission we will take. The commissions for this specific service are not fixed and are to be agreed upon on a case-by-case basis depending on the sought after article. The time it will take for us to find the item, if we find it, and ship it to you will depend on its availability and location.

When you wish to consign luxury items with us. Simply click on “Consign with Chadi” on our website www.chadiluxury.com. Fill in the requested information. We will write back to you either validating your request to consign your item(s) with us or refusing your item(s). We reserve the rights to refuse an item if a) its condition is not at the minimum required condition criteria which is good condition (see Condition Criteria), (b) if the brand does not fit our requirements, (c) if the item is not commercially attractive. In all cases, Chadi – Feel Good Luxury reserves the right to accept or not any item you wish to consign.

We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

Collection or Consignment by you. If you wish to meet face-to-face to either collect the products you have ordered for if you wish to deposit your consigned items directly, you can contact us at: info@chadiluxuruy.com to agree on a place, time and date at which you will be able to either pick up your order or consign your items.

Where are your consigned items kept. Your goods are kept safely at our headquarters until sold.

If you are not at home when the product is delivered. If no one is available at your address to take delivery and the products cannot be posted through your letterbox, our secured contractor will leave you a note informing you of how to rearrange delivery or collect the products from a local depot.

If you do not re-arrange delivery. If you do not collect the products from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot, it will be at your own expenses and responsibility.

When you become responsible for the goods. A product which is goods will be your responsibility from the time we deliver, or attempt to deliver (check 'If you are not at home when the product is delivered" for more information), the product to the address you gave us or you collect it from us.

When you own goods. If you are a buyer, you own a product once we have received payment in full. If you are a consignor, you own a product until it is sold to a buyer and you receive your payment.

What will happen if you do not give required information to us. We may need certain information from you so that we can supply the products to you, for example, address of delivery. If so, this will have been stated in the description of the products on our website. We will contact you in writing to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may either end the contract or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result.

Reasons we may suspend the supply of products to you. We may have to suspend the supply of a product to deal with technical problems or make minor technical changes to our website.

When you wish to consign luxury items with us. Simply click on “Consign with Chadi” on our website www.chadiluxury.com. Fill in the requested information. We will write back to you either validating your request to consign your item(s) with us or refusing your item(s). We reserve the rights to refuse an item if a) its condition is not at the minimum required condition criteria which is good condition (see Condition Criteria), (b) if the brand does not fit our requirements, (c) if the item is not commercially attractive. In all cases, Chadi – Feel Good Luxury reserves the right to accept or not any item you wish to consign. Once we have validated your item(s) you wish to consign, simply pack your item(s) in a box, provide us with the box's dimensions, let us know when you are ready for pick-up and provide us with your pick-up address. We will provide you with a label to print and stick to your box. Our local secured contractor will come at your given address to collect the parcel. You will receive an email notification upon reception. Our team led by Swiss experts thoroughly checks and certifies each item. Except for Hong Kong & Switzerland, the shipping costs are at the consignor’s own charge and responsibility. For Hong Kong & Swiss consignors, we offer free pick-up service for your consigned items.

Collection or Consignment by you. If you wish to meet face-to-face to either collect the products you have ordered for if you wish to deposit your consigned items directly, you can contact us at: info@chadiluxuruy.com to agree on a place, time and date at which you will be able to either pick up your order or consign your items.

Shipping costs:

For Sellers or Consignors. For buyers or consignors based in Hong Kong & Switzerland, shipping costs are waived. Chadi – Feel Good Luxury’s secured contractor will collect your item(s) to consign for free. Simply pack your item(s) in a box, provide us with the box's dimensions, let us know when you are ready for pick-up and provide us with your pick-up address. We will provide you with a label to print and stick to your box. Our local secured contractor will come at your given address to collect the parcel. For all other international consignors (all countries except Hong Kong & Switzerland), shipping costs and shipping set ups are at the consignor’s own charge and responsibility. We recommend to use FedEx as they are top professionals and will do their utmost best to make sure your package(s) reach(es) our offices.

Our website’s commission on your consigned item(s). If you wish to sell your luxury items via our website, you are referred to as the ‘seller’ or the ‘consignor’. As soon as a consigned item of yours is sold to a buyer, we credit your bank account with the due amount. On that amount, Chadi - Feel Good Luxury takes a 25% commission on the net selling price for items between USD 0 to USD 5,000, 20% for items between USD 5,001 to USD 10,000, 15% for items between USD 10’001 to USD 20’000 and 10% for items above USD 20’000. Please note that the commission for very rare and ultra high-end value products can be further discussed. If you do have a very rare and ultra high-end value product to consign, please contact us: info@chadiluxury.com.

Net Selling Price. A net selling price is a price at which an item is sold less applicable discounts, promotions and excluding taxes and shipping.

Import duties, taxes (VAT) and customs’ fees into Hong Kong. There are no import duties, taxes and customs fees for consignors as we are located in Hong Kong which is a tax-free focal point for efficient luxury goods logistics.

Title to property. As a seller or consignor, you will continue to own each item until that item is sold.

An item will be considered sold when: 1) it is sold to a client, 2) it is lost, stolen, damaged or destroyed while kept at our secured headquarters in Hong Kong.

Risk of loss of property. If any item(s) of yours gets damaged, stolen or lost while in our property, we will pay you a fair market value of the item.

Counterfeit or stolen items. You are responsible for ensuring that all the items you wish to consign to Chadi – Feel Good Luxury are authentic. If we fail to validate the authenticity of the consigned item(s), we reserve the right to refuse it/them. If we determine that the consigned item is a counterfeit, we will notify you and you will have the opportunity to prove that the item is authentic. If you fail to do so, the item will not be returned to you and will be destroyed. Chadi – Feel Good Luxury is subject to laws and regulations relating to claims that consigned items are counterfeit, have been stolen, or otherwise violate applicable law. In addition, will fully cooperate with law enforcements in all investigations.

If there is a problem with the product. If there is a problem with the product you have consigned, we will contact you via email to inform you and we will ship your item back. We will charge you with transportation and administration costs.

Consignment period. The consignment period lasts a full year, 365 days, from the day you receive an email notification from us that we have received your item(s). During the course of the said year, you can request within the first 90 days of the consignment period by email at customerservice@chadiluxury.com to have your consigned item(s) returned. We will charge you with transportation and administration costs and we will return the item(s) within 30 days once we have received the cost of administration and transportation. After the 365 days, you can either request to have your product returned to you and we will return the item to you within 30 days once we have received the cost of administration and transportation or we reserve the right to offer you a fair market value price for your item(s). You can accept or refuse. If you refuse, we will send the item(s) within 30 days once we have received the cost of administration and transportation.

Where to find the price for the product. The price of any product (which excludes any VAT) can be found next to each product that is available for sale. The price of each product is also indicated on the order pages when you placed your order.

How do we price each item. Once your items are received, assessed, authenticated and certified by our experts, the fairest price for pre-owned luxury goods is determined on a case-by-case basis. The consignor can share a suggested selling price. We will make all commercially reasonable efforts to sell the consigned item and will determine the selling price for each item based on its evaluation, together with a determination of the current market price. Our aim is to sell your item(s) at the highest possible price within the first 30 days. In order to market and promote the sale of each item, we reserve the right to apply an immediate discount to the consigned item, which will affect the item’s initial sale price. Additionally, we reserve the right to apply 10%, 20%, 30% up to 60% discounts on the item to sell, unless you have otherwise requested in writing a specific minimum price at which a specific item must be sold.

Our website’s commission on your consigned item(s). If you wish to sell your luxury items via our website, you are referred to as the ‘seller’ or the ‘consignor’. As soon as a consigned item of yours is sold to a buyer, we credit your bank account with the due amount. Currency settings.The website’s base currency is USD. The other available currencies: CHF, HKD, GBP, EUR, CNY, JPY, and AUD are only for the viewer’s information. Each currency’s rate is for informational purposes only and does not reflect spot rates. The only valid sale price is in USD.

When you place your order, you will always be charged in USD as it is the website’s base currency. If your payment option is registered with a different currency than USD, your bank will convert the price using their exchange rate.

What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any goods provided to you.

When you must pay and how you must pay. When: at the time of your order. How: easy and convenient, our payment process is safe and secure. We process payments by credit cart (VISA, MC, AMEX) as well as Apple Pay and Google Pay. Please note that Apple Pay will only be available if our payment gateway detects that Apple Pay is already setup in your iPhone. Same for Google Pay, it will only be available if our payment gateway detects that Google Pay is already setup in your phone. You must pay for the products before we dispatch them. We will charge your credit once you confirm your order.

What to do if you think an invoice is wrong. If you think an invoice is wrong please contact us promptly to let us know at: customerservice@chadiluxury.com.

If you wish to make a change to your order please contact us:

customerservice@chadiluxury.com. We will let you know if the change is possible. If it is possible we will let you know about any cost changes, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to end the contract (see Your rights to end the contract).

We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. Our site is made available globally. We do not take responsibility that content available on or through our site is appropriate under each country’s jurisdictions.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will only use your personal information as set out in our Privacy Policy.

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. Your orders may be subject to sales, use, excise and other tax depending on the country you wish the order to be delivered to and its jurisdictions. It is the buyer's responsibility to ascertain and pay all taxes due.

You can always end your contract with us. Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing and when you decide to end the contract.

Ending the contract because of something we have done or are going to do. If you are ending a contract for a reason set out at (a) to (c) below, the contract will end immediately and we will refund you in full for any products which have not been provided and you may also be entitled to compensation. The reasons are:

(a) we have told you about an upcoming change to the product or these terms which you do not agree to

(b) we have told you about an error in the price or description of the product you have ordered and you do not wish to proceed

(c) there is a risk that supply of the products may be significantly delayed because of events outside our control

No assignment. You may not assign this contract or any interest you have in it without our prior written consent. Any prohibited assignment is null and void.

No implied waiver. Any failure by you or by us to enforce any provision of this contract shall not constitute a waiver of such provision or of any other provision of this contract.

Severability. If any term of this contract is found by any court to be void or otherwise unenforceable, the remainder of this contract shall remain valid and enforceable as though such term were absent upon the date of the execution of this contract.

Tell us you want to end the contract. To end the contract with us, please let us know by doing one of the following:

(a) Email. Email us at customerservice@chadiluxury.com. Please provide your name, home address, details of the order and, where available, your phone number and email address.

(b) By post. Write to us at our headquarters’ address (Unit B, 14 Headland Road, Repulse Bay, Hong Kong), including details of what you bought, when you ordered or received it and your name and address.

We may end the contract if you break it. We may end the contract for a product at any time by writing to you if:

(a) you do not make any payment to us when it is due;

(b) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products, for example, address of delivery;

(c) you do not, within a reasonable time, allow us to deliver the products to you or collect them from us;

You must compensate us if you break the contract. If we end the contract we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.

If you are a seller or a buyer, please note that these terms of use, their subject matter and their formation, are governed by Hong Kong law. You and we both agree that the courts of Hong Kong will have exclusive jurisdiction.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by Hong Kong law. We both agree to the exclusive jurisdiction of the courts of Hong Kong.

After purchase and delivery. After purchase and delivery, items are not exchangeable or refundable; they correspond to a detailed description on the e-commerce platform www.chadiluxury.com.

Should an item not be suitable. Should an item not be suitable (e.g. not the right size for you, not the right color for you, etc.), it is possible to sell it back on the platform 7 days of receipt of the goods, at the price of purchase (i.e. net selling price) or a reviewed price (i.e. we may agree together to sell the item at a higher or lower price vs. the net selling price. However, we reserve the right to decide at which price we will re-list the item). We will charge zero commission, only transportation and administration costs. Returned items will be accepted under the condition they still hold the Chadi – Feel Good Luxury’s tag.

Re-listing of a purchased item. Make sure you contact us: customerservice@chadiluxury.com to request a re-listing of the purchased item.

Nobody else has any rights under this contract (except someone you pass your guarantee on to). This contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.

If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by Hong Kong law and you can bring legal proceedings in respect of the products in Hong Kong courts.

Alternative dispute resolution. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court.
